Construction and Infrastructure
Construction and infrastructure sectors lie at the core of Göksu’s areas of expertise. We are proud to be a go-to choice for legal advice for many of the world’s major contractors, civil and consulting engineering firms, architects and other construction professionals. We work closely with Turkey’s world-class contractors that dominate ENR Top 250 lists year after year. We also have a reputation for assisting international contractors and engineering firms active in Turkey with their procurement and delivery of major projects and resolution of complex disputes.
Thanks to our specialist knowhow in this field, our team is regularly relied upon for academic or professional lectures. Our attorneys provide training to in-house lawyers, contract managers and project directors. In the recent years, we organized FIDIC training sessions hosted by the Turkish Contractors’ Association. We also acted as expert lecturer for the Turkish Ministry of Transport’s in-house lawyers and engineers on the FIDIC rainbow suite.
Non-contentious Work
At Göksu, we understand the unique challenges that construction industry actors face. With a team of technically trained lawyers, we provide end-to-end project advice from the early tender stage to the final acceptance. We help clients with procurement from around the world and negotiation of highly specific particular conditions based mostly on government templates or FIDIC general conditions of contract.
Our services are geared toward mitigating risks, seeking consensus, and maintaining relationships between opposing project participants. Our approach is always commercially-minded, with the end goal being our clients’ trusted advisors towards completion on time and within budget.
With this mindset, we have built a reputation for having advised main contractors and engineering firms on several landmark projects, including mega airports, high-speed railways, suspension bridges, gigawatt power plants, oil and gas pipelines spanning continents, high-security embassy buildings, central bank headquarters and luxury hotels.
Contentious Work
As construction lawyers, we recognize that disputes are almost inescapable in large-scale infrastructure projects. Despite all good-faith efforts, some construction disputes are simply too complex or too polarizing for amicable resolution. In such cases, we fight to achieve the best possible outcome for our clients.
Our construction dispute resolution services are diverse. At the early stage of a dispute, we assist clients with drafting claim letters and other formal notices. We often work with claim consultants, quantity surveyors, delay experts and quantum experts to develop delay/disruption claims, extension of time claims and similar contract claims. When retained by contractors or suppliers, we also defend against employers’ defects and negligence claims. In aid of full-fledge litigation or arbitration, we devise corollary strategies, such as to protect guarantee bonds from unjustified encashment attempts, via court-issued or arbitrator-issued injunctions.
Once a dispute matures into the final battle stage, we represent clients before dispute adjudication boards, arbitral tribunals and State courts. We have acted as counsel in, or advised on, numerous construction projects involving airports, pipelines, roads, bridges, tunnels, railways and metros, conventional power plants, wind and solar farms, and renewable energy plants, factories and industrial facilities, embassy buildings, luxury hotels, central bank headquarters and shopping malls, among others.
Finally, we are considered by many industry professionals and publications as a leading choice for domestic and international construction disputes. Every year since 2017, Who is Who Legal has listed Noyan Göksu as one of the leading construction disputes lawyers in Turkey. Other publications such as Legal500 and Chambers & Partners also list Göksu attorneys as among the cream of the crop in Turkish dispute resolution.
